Question: I am starting a business and want to make sure that I am in compliance with the regulations, requirements, licenses, permits, etc. Where do I begin?
Answer: The first step in the process is to contact the Business ServiCenter at (800) 228-8443 to check on any state licensing requirements for your business.
The next step is to check with your local zoning department to make sure that you are in conformity with all zoning regulations, even if you plan to work out of your home.
The third step is to decide on your legal form of business organization such as sole proprietorship, partnership, limited liability company, or corporation.
The fourth step is to register that entity per local or state regulations. A Sole Proprietorship or a Partnership must register with the Register of Deeds, 720 E. Fourth Street, Charlotte, (704) 336-2443. A Corporation or Limited Liability Company (LLC) must follow the instructions by the Secretary of State. Go to www.sosnc.com – Corporations Division.
Following approval and/or receipt of filing you will need to get an “Employer Identification Number” (EIN) from the Internal Revenue Service. Go to www.irs.gov and follow instructions.
If you will need a Sales Tax Number and/or have any employees, you must file with the North Carolina Department of Revenue at www.dor.state.nc.us/business, form AS/RP 1.
Additionally, for businesses with employees, you will need to register for North Carolina Unemployment Insurance at www.ncesc.com.
Most businesses will also be required to obtain a Business (Privilege) License at 700 North Tryon Street, (704) 336-6315 and also contact the Business Listing Department (704) 336-6382 for payment of business personal property taxes.
